Terms of Service

These terms are provisional while they complete independent legal review. We will publish the final wording in the app.

1. Acceptance of Terms

By using CommunityRide, you agree to these Terms of Service. If you do not agree, do not use the app. These terms apply to all users, including riders and drivers.

2. Eligibility

You must be at least 18 years old, a verified member of a registered community, and hold a valid driving licence (if acting as a driver) to use CommunityRide. Membership requires approval by your community administrator.

3. We are a coordination platform only

CommunityRide connects neighbours who want to travel together. We do not provide transport. We are not a taxi service, a private hire operator, a transport operator, a taxi aggregator, or a radio taxi service. We do not employ, engage or supervise drivers, we do not control routes or timings, and we are not a party to any arrangement a driver and a rider make with each other. Any journey is a private arrangement between the members involved.

4. Cost sharing and no profit

Where a community uses cost sharing, any contribution must be agreed before the journey starts and must not exceed a fair share of the running costs of that journey. The driver must not make a profit from carrying passengers.

United Kingdom: A journey where payments do not exceed running costs and are arranged in advance falls outside the definition of carrying passengers at separate fares under section 1(4) of the Public Passenger Vehicles Act 1981. If you charge more than cost, you may be operating an unlicensed service and committing an offence.

India: Commercially aggregating rides for fare or reward without the required licence may violate the Motor Vehicles Aggregator Guidelines, 2020 and applicable State-level transport regulations.

United States: Contributions are calculated as a share of the local ride-hail market rate. Drivers must not profit beyond offsetting running costs.

Drivers must not advertise or solicit passengers from the general public, must not tout for fares, and must not use the app to run a commercial transport business. Rides are offered only to verified members of your own community.

5. Insurance and driving licence

Drivers must hold a valid driving licence and valid motor insurance covering the vehicle and the journey, and must confirm with their insurer that the policy permits carrying passengers in return for a contribution towards costs. Carrying passengers for hire or reward, or for profit, is generally excluded from ordinary motor insurance policies and can invalidate your cover. Checking this is your responsibility, not ours. We do not verify insurance policies or licences.

6. Vehicle roadworthiness

Drivers must keep the vehicle roadworthy and legal, including where applicable: a valid MOT certificate (UK), valid vehicle tax (UK), a valid Pollution Under Control (PUC) certificate (India), valid vehicle registration under the Motor Vehicles Act 1988 (India), and a valid fitness certificate where applicable. Drivers must accurately describe the vehicle in the app.

7. No unaccompanied minors, no background checks

You must not use CommunityRide to arrange transport for anyone under 18 who is not accompanied by their own parent or guardian. CommunityRide carries out no DBS check (UK), no criminal record check, no police verification (India), and no enhanced safeguarding check on any driver or member. Community verification is an identity check only. Do not treat a verified badge as a safeguarding assurance.

8. Payments

CommunityRide does not process, hold, route, or settle any payment. It is not a payment aggregator or payment gateway and is not regulated as such by the RBI (India) or the FCA (UK). All contributions are settled directly between the rider and the driver through their own payment apps (Venmo, Cash App, Zelle in the US; Monzo, Revolut, bank transfer in the UK; UPI, PayPal, bank transfer, or cash in India).

CommunityRide allows voluntary tips from riders to drivers. Tips are not mandatory and do not represent payment for transport services.

9. Limitation of Liability

CommunityRide is provided "as is". Because we only put members in touch with each other, we are not responsible for how anyone drives, for the condition of any vehicle, for anything that happens on a journey, for a member's conduct, or for whether a contribution is actually paid. To the fullest extent the law allows, Ajanta LLC is not liable for any indirect, incidental or consequential loss, or for loss of profit, arising from your use of the service.

Nothing in these terms limits or excludes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.

10. Indemnity

If someone brings a claim against us because of what you did, you agree to cover our reasonable losses, costs and legal fees. This applies where the claim arises from your use of the service, from a journey you drove or took, from breaking these terms, from driving without valid insurance, a valid licence, or a roadworthy vehicle, from taking more than a share of costs, or from breaking the law.

11. Account Termination

Community administrators may suspend or revoke membership for violations of community rules or these terms. CommunityRide may terminate access to the platform for violations of these terms.

12. Changes to Terms

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the new terms.

13. Governing law

United Kingdom: These terms are governed by the law of [England and Wales / Scotland / Northern Ireland — to be confirmed].

United States: These terms are governed by [US governing law and venue — to be confirmed].

India: These terms are governed by the law of [jurisdiction within India — to be confirmed].

Wherever you are, you may always bring proceedings in the courts of the country where you live if the law gives you that right.
